net-files GmbH takes protection of your personal data very seriously and would like to ensure that as a user of the net-files web site and web applications, your privacy is protected. For this reason, we compiled this data protection policy, in which we clarify how we handle the personal data that is gathered when you use our web site and web applications. net-files GmbH (henceforth referred to as the "Provider") pledges to adhere to the requirements of the EU data protection guidelines and to the laws and regulations of the Federal Republic of Germany, in particular the Federal Data Protection Law ("BDSG") and the Telemedia Act ("TMG"). The following statement gives you (referred to as the "User") an overview of how we can guarantee this protection and which data is retained and for what purpose.

Personal data

Personal data are individual details about the personal and factual circumstances of a specific or definable individual person ("data"), § 3 (1) BDSG. This includes information such as your name, your address or your telephone number.

Collection and processing of personal data

When a user visits the provider's web pages, the web server automatically collects and saves information that the user's browser sends in its server log files. This information consists of:

  • browser type and version
  • operating system being used
  • referring URL (the web page visited previously)
  • the web pages that the user is visiting
  • the date, time and duration of the visit
  • the host name of the computer that is accessing (IP address)

net-files GmbH is not able to match this information with any particular person. This information is not merged with data from other sources. The log files are deleted according to the legal specifications.

Additional personal data such as the user's name, address, telephone number or e-mail address will not be retrieved when the user visits the web site. Unless this information is provided by the user willingly, for example, in the course of registering with the service, completing a survey, or if the user requests information from the provider or completes a contract.

Use and transfer of personal data

The personal data provided by the user will be used by the provider only for the purpose of the technical administration of the web site and for the fulfillment of the user's wishes and requirements, typically in order to reply to a query or to complete the contract closed with him.

The provider only uses this data for product-related surveys and marketing purposes if the user has given his or her agreement or - if legal provisions allow - has not refused to permit this use.

You can withdraw this statement of consent at any time, effective for the future. All you need to do is send an e-mail to the following address: Datenschutz(at)net-files.de. The users's personal data will expressly and exclusively not be sold to a third party. The users's personal data will only be passed on or otherwise transferred to a third party within the framework of a data processing agreement according to § 11 BDSG for accounting purposes and marketing support.

If certain conditions are fulfilled, the provider is authorized to collect, process and use personal data that are required for the purpose of disclosing and canceling illegal usage and for the enforcement of claims. If necessary in an individual case, the provider is entitled to record, process and use the user data and connection data of those involved to identify, limit and eliminate defects and faults in communication systems.

According to the applicable provisions, the provider is entitled to provide the prosecution authorities and courts with information for the purposes of prosecution.

Use of cookies

The net-fies GmbH web site and applications use so-called cookies in several places. Cookies are small text files that are stored in the user's web browser.

Browser cookies are used to make our service more user-friendly, efficient and secure, to identify you as a user during your visit to the web site and while using the provider's services, and to save technical data on your computer to help individual services work correctly. Most of the cookies used by the provider are so-called "session cookies". These are automatically deleted when you are finished visiting our web site our using our service.

In addition, we use Google Analytics, the web analysis service by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereafter: "Google"), for the purpose of analysing and improving our web site. This tool also uses cookies. The information that is gathered about how the provider's web site is used (including your IP address) are sent by your web browser to a Google server in the USA and stored there. Google Analytics uses this information to furnish the provider with an analysis of the use of its web site and to compile reports for us on web site activities. Insofar as it is required or allowed by law, Google will pass this information on to third parties, where required. Google will not link your IP address with any other data that were gathered by them.

If you do not wish to use cookies, you can deactivate them in your browser. We cannot guarantee in this case that all parts of the provider's web site and services will function properly.

Security

The provider carries out extensive technical and organisational security measures to protect the user’s personal data against loss and misuse. The user’s data is stored in a secure operating environment that is not publicly accessible. In certain cases, particularly when using the provider's web application, personal data is encrypted during transmission by means of Secure Socket Layer technology (SSL). This means that communication between the user’s computer and the provider’s servers uses a recognised encryption technique.

If the user contacts the provider by e-mail, the provider informs the user that the confidentiality of the transmitted information cannot be guaranteed. The content of unencrypted e-mails can be viewed by third parties. The provider therefore recommends always sending confidential information by post.

Data retention

Your data will only be stored for as long as is necessary for our service delivery, or for as long as we are legally required to store it.

Right to information

Your trust is important to us. Because of this we will always answer any questions you have about the use of your personal data.
